AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR HIRING A SPECIAL
EVENT CONSULTANT, AND FOR OTHER PURPOSES.
WHEREAS, A.C.A. Section 14-58-303 allows waiving of
competitive bidding in exceptional situations where such procedure
is deemed not feasible or practical; and
WHEREAS, there are may items necessary for the City's use
where competitive bidding is deemed not feasible or practical; and
WHEREAS, the City of West Memphis and the Advertising and
Promotion Commission are in need of hiring a special event
consultant to direct the 1995 Livin' On The Levee Festival, to
solicit sponsorships for Livin' On The Levee, to oversee the filing
of 501(c)(3) tax exemption status for Livin' On The Levee, to
submit recommendations for the 1996 Livin' On The Levee, to assist
in setting up new bylaws for Livin' On The Levee, and to provide
advisory services for other special events as recommended by the
Advertising and Promotion Commission; and
WHEREAS, time is of the essence in that in order to prepare
for the 1995 Livin' On The Levee Festival without further
unnecessary delay it is necessary to have the special event
consultant begin work as soon as possible; and
WHEREAS, it would not be feasible or practical to require
competitive bidding for such services under the present
circumstances;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following
services to be used by the City, described as follows:
A special event consultant to assist in the planning and
organization of the 1995 Livin' On The Levee Festival and to
make recommendations for the 1996 Livin' On The Levee Festival
and to provide advisory services to the Advertising and
Promotion Commission in an amount not to exceed $12,000.
2. Competitive bidding is found to be neither feasible or
practical under the present circumstances in that the special event
consultant must begin work as soon as possible and without delay in
order to prepare for the 1995 Livin' On The Levee Festival and that
time is of the essence.
