AN ORDINANCE TO REZONE A PARCEL OF LAND LYING IN THE CITY
OF WEST MEMPHIS, CRITTENDEN COUNTY, ARKANSAS FROM R-l,
SINGLE FAMILY RESIDENTIAL DISTRICT TO PUD, PLANNED UNIT
DEVELOPMENT DISTRICT, DECLARING AN EMERGENCY AND FOR
OTHER PURPOSES.
WHEREAS, application was made to the City Planning
~" ~ Commission to rezone the hereinafter described property, and
after notice having been published for the time and in the
manner provided by law, the matter having been set for hearing
by the City Planning Commission, and after hearing the
Planning Commission recommended that the application be
approved and the City Council finds that such application
should be granted; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS, ARKANSAS:
SECTION I: That the following described property located
in the City of West Memphis, Crittenden County, Arkansas, to
wit:
49.73 Acres lying in the East one-half of Section 14,
Township 6 North, Range 8 East, Crittenden County,
Arkansas particularly described as follows:
Commencing at the Northeast corner of said Section 14,
thence North 87 degrees 37 minutes East along the centerline
of U.S. Highway 70 a distance of 44.30 feet call distance 40.0
feet, thence South 0 degrees 27 minutes 00 seconds East a
distance of 60.03 feet to its intersection with the South
right-of-way line of U.S. Highway 70, thence South 87 degrees
37 minutes 00 seconds West along said South right-of-way line
a distance of 77.38 feet, thence South 00 degrees 00 minutes
54 seconds East along said right-of-way line a distance of
24.91 feet, thence North 71 degrees 13 minutes 49 seconds West
along said right-of-way line a distance of 2.57 feet to the
Northeast corner of the Lutheran Church property, thence South
0 degrees 27 minutes 00 seconds East a distance of 503.02 feet
to the Southeast corner of the Lutheran Church property,

350.13 feet to the point of beginning, thence continue South

seconds West a distance of 430.76 feet to its intersection
with the South right-of-way line of U.S. Highway 70 also the

of-way line a distance of 108.32 feet to a point, thence South
85 degrees 42 minutes 27 seconds West along said right-of-way
line a distance of 300.17 feet to a point, thence North 89
degrees 31 minutes 16 seconds West along said right-of-way
line a distance of 69.98 feet to its intersection with the
centerline of Ten Mile Bayou, thence along the centerline of

County, Arkansas thence North along the West line of
Meadowbrook Village subdivision as distance of 189.24 feet,
thence along a curve that breaks to the right with a radius of
377.33 feet an arc length of 299.63 feet, thence North 45
degrees 30 minutes 00 seconds East a distance of 33.42 feet,
thence along a curve that breaks to the left with a radius of
585.85 feet an arc length of 221.96 feet to the Southeast
corner of Beverly Place Subdivision as shown by plat recorded
in Plat Book 4, Page 87, thence North 80 degrees 26 minutes 12
seconds West along the South line of Beverly Place Subdivision
a distance of 357.03 feet to the Southwest corner, thence
North 09 degrees 33 minutes 48 seconds East along the West
line of Beverly Place Subdivision a distance of 514.71 feet to
the point of beginning, containing 49.73 acres more or less.

SECTION II: All building setback lines will be
documented on preliminary and final subdivision plats and the
square footage shown for each dwelling unit is for heated
area.
SECTION III: That all ordinances or parts of ordinances

in conflict herewith are hereby repealed.
SECTION IV: EMERGENCY CLAUSE: It is found and
determined by the City Council that this ordinance is
necessary for the owner of the property to be able to properly
utilize such property for development which includes an urgent
need to begin construction; and this ordinance is necessary
for the growth and expansion of the city of West Memphis, and
that the passage of this ordinance is in the interest of the
public health, peace, safety and welfare of the city of West
Memphis and the inhabitants thereof. Therefore, an emergency

effect and be in force immediately on its passage and
approval.
