AN ORDINANCE GRANTING A SPECIAL PERMITTED USE FOR
A PARCEL OF LAND LYING EAST OF CLUB ROAD AND NORTH
OF U.S. HIGHWAY 70 CONTAINING 13.5 ACRES, MORE OR LESS
WITH A COM50SERVDCESROAD,3DECLARINGEANBEMERGENCY ANDS
ROAD & I 5
FOR OTHER PURPOSES
WHEREAS, Application was made to the City Planning Commission
of West Memphis, Arkansas to allow a Special Permitted Use of the
hereinafter described lands for the development of a Multi-Family
Apartment Complex (per Zoning Ordinance 1258, as amended); and
WHEREAS, Notice of said hearing has been published for the time
and in the manner as provided by Ordinance No 1258, the matter was
heard by the City Planning Commission at the April 26, 1995 and upon
the matter being heard by the City Planning Commission and further due
consideration thereof the City Planning Commission recommended that
said Application be granted provided the following stipulations were
agreed upon by the Applicant, to wit:

' NOW, TI~iEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
SECTION I: That the following described property, to wit:
A strip of land, approximately 13.5 acres in size, lying
east of Club Road and North of U.S. Highway 70, being
more particularly described as: Commencing at the S.E.
corner of Section 9, thence North along the East line of
Section 9 a distance of 125.3 feet to the North right-
of-way line of U.S. Highway 70, thence West along said
right-of-way line 1155.4 feet to the S.E. corner of the
Esso property, said point being the point-of-beginning,
thence North along the East line of said Esso property
300.0 feet to the N.E. corner of the Esso property,
thence continue North a distance of 300.0 feet, thence N
66 degrees 28 minutes 30 seconds West a distance of
668.16 feet, more or less, to the South right-of-way
line of Interstate Highway 55, thence in a northeasterly
direction along siad right-of-way line a distance of 483
feet, more or less, thence in a southeasterly direction
' along said right-of-way line a distance of 1171 feet,

right-of-way line a distance of 65.85 feet, thence in a
southwesterly direction along the right-of-way line of
Interstate 55 and U.S. Highway 70 a distance of 1071
feet, more or less, to the point-of-beginning containing
13.5 acres, more or less, being the same as 3850-3898 E.

be, and the same is hereby, granted a Special Permitted Use allowing
and permitting the use of the aforedescribed property for the
development of a Multi-Family Apartment Complex to be constructed
thereon in a C-2 open Display Commercial District.
SECTION II: That all Ordinances or parts of Ordinances in
conflict herewith are hereby replealed.
GFCTTnN III: EMERGENCY CLAUSE: It is found and determined by
the City Council that the aforedescribed property is to be purchased
for the proposed contruction of a Multi-Family Apartment Complex and
is conducive to the orderly growth and expansion of the City of West
Memphis and the immediate operation of the provisions of this
Ordinance are necessary for the current owners of the property to be
able to consumate the sale of the aforedescribed property to the
proposed Purchaser of same for the development of a Multi-Family
Apartment Complex to be located thereon and that the passage of this
Ordinance is necessary for the preservation of the public peace,
health and welfare of the City and the inhabitants who will live in
~ the proposed constructed facility, there being a shortgage of such

is hereby declared to exist and this Ordinance shall be in full force
and effect from and after its approval and passage.
