AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE APPLICATION OF AN
EPOXY SEALER TO THE FLOOR OF THE ANIMAL SHELTER, DECLARING AN

EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving
of competitive bidding in exceptional situations where such procedure
;~ ~ is deemed not feasible or practical; and

WHEREAS, there are many items necessary for the City's use where
competitive bidding is deemed not feasible or practical; and
WHEREAS, the West Memphis Animal Shelter is charged with providing
a safe and healthy environment for the animals that it keeps; and
WHEREAS, the West Memphis Animal Shelter currently has unsealed
concrete floors that are cracked and impossible to clean and sterilize;
and
WHEREAS, this situation is causing many animals to get sick and
die; and
WHEREAS, this situation is posing a health hazard not only for the
animals, but also the workers, many of whom are volunteers; and
WHEREAS, the State Department recommends the floors be etched, all
` cracks filled, and the entire surface be sealed with an epoxy sealer;
and
WHEREAS, it is very specialized work and City employees are not
experienced nor qualified in putting down such a sealant; and
WHEREAS, a local contractor has the expertise and material to put
epoxy down; and
WHEREAS, the City of West Memphis is in need of applying an epoxy
sealer to the West Memphis Animal Shelter and Mid-South Cleaning
Systems is a local contractor that can do the work immediately, and
competitive bidding under such circumstances would not be feasible or
practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WEST MEMPHIS, ARKANSAS:.
1. That competitive bidding be waived for the following item to be
used by the City, described as follows:
The application of an epoxy sealer to the floor of the animal
shelter by Mid-South Cleaning Systems for a cost to the City not
to exceed $6,000.
2. EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Memphis, Arkansas, that there is an
urgent need by the City of West Memphis for this work to provide a safe
and healthy environment for animals and human workers., an emergency is
hereby declared to exist, and this Ordinance being necessary for the
preservation of the public peace, health, safety and welfare of the
citizens of West Memphis, Arkansas, shall be in full force and effect
from and after the date of its passage and approval.
