AN ORDINANCE GRANTING A SPECIAL PERMITTED USE FOR A RESIDENTIAL
DAY CARE CENTER ON A LOT CONTAINING NOT LES5 THAT 20,000 SQUARE
FEET ON THE PROPERTY LOCATED AT 1014-1020 WINCHELL AT GARRISON,
ALSO KNOWN AS LOT 10 AND A FRACTIONAL PART OF LOTS 4-A, 5 AND 9-A,
BLOCK 10, HAISCH SUBDIVISION, WEST MEMPHIS, ARKANSAS, AND FOR
OTHER PURPOSES.
WHEREAS, application was to the City Planning Commission of West
Memphis, Arkansas, to allow a Special Permitted Use of the hereinafter
described lands for the development of a Residential Child Care Center
having not less than 20,000 square feet of area fronting a collector
street and designed and constructed with the character of a residential
single family structure. This structure may or may not be the
permanent residence of the operator (per Zoning Ordinance No. 1258, as
amended); and
WHEREAS, Notice of said hearing has been published for the time
and in the manner as provided by Ordinance Nn. 1258, the matter was
heard by the City Planning Commission on May 31, 1995, and upon the
matter being heard by the City Planning Commission and due
consideration given thereof the City Planning Commission recommended
~ that said Application be granted provided the following stipulations
were agreed upon by the Applicant, to wit:

1. Hours of operation (6:00 A.M. - 7:00 P.M.);
2. Landscape (per Design Review Commission review);
3. Number of children, must meet state requirements but must not
exceed 65 as per the Planning Commission recommended as a
stipulation;
4. Must meet all State Codes, County local requirements;
5. Sidewalk installation;
6. No sign to denote business;
7. Trash recepticals must be screened with site proof fence;
8. Play area screened with site proof fence;
9. Day Care be operated in a manner that will not change the
residential character of the structure;
10. No parking on Winchell Street or Garrison Avenue.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

WEST MEMPHIS, ARKANSAS:
SECTION I: That the following described property to wit:

Legal Description: Lots 10 and a fractional part of Lot 4-1, 5
and 9-1, Block 10, Ha~sch Subdivision
be and the same is hereby, granted a Special Permitted Use allowing and
permitting the use of the aforedescribed property for the development
of a Residential Child Care Center having not less than 20,000 square
feet of area fronting a collector street and designed and constructed
with the character of a residential single Family structure. This
