AN ORDINANCE GRANTING A SPECIAL PERMITTED USE FOR THE PROPERTY
LOCATED AT 204-206 GRAHAM ALSO KNOWN AS THE SOUTH 5 FEET OF
LOT 23 AND ALL OF LOT 24 AND 25 FLOCK 4 THOMPSON 2NrD
SUBDIVISION, WEST MEMPHIS, ARKANSAS, DECLARING AN EMERGENCY
AND FOR OTHER PURPOSES.
WHEREAS, application arias to the City planning Commission to
allow the special permitted use of the property located at 204-206
Graham, West Memphis, Arkansas, for a Retail-Wholesale
establishment and after notice having been published for the time
and in the manner as provided by Ordinance No. 1258 the matter was
heard by the City Planning Commission and no persons appearing to
protest the same the Planning Commission recommended that said
application be granted on the condition that:
(1) 6-8 foot site proof fence must be erected at property
line where outside display of material will be located.
(2) Landscape be planted as recommended by the Design Review
Commission Site plan review.
NOW, THEREFORE, SE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
SECTION I: That the following described property to wit:
Common address: 204-206 Graham
Legal Description: South 5 feet of Lot 23 and all of Lot 24
and 25, Block 4 Thompson 2nd Subdivision
be and the same is hereby granted a Special Permit Use allowing and
permitting the use of the building at 204-206 Graham to be used as
a Retail-Wholesale establishment in a C-1 Zone of the conditions
that:
(1) 6-8 foot site proof fence must be erected at property

SECTION II: That all ordinances or parts of ordinances in
conflict herewith are hereby repealed.
SECTION III: EMERGENCY CLAUSE: It is found and declared by
the City Council of the City of West Memphis that this property is
in the process of further development and use and this ordinance
must be effective immediately in order that the developer may move
from temporary facilities to a permanent facility, and that this
ordinance is necessary for the orderly growth and expansion of the
City of West Memphis and for the protection of the safety and
welfare of the inhabitants of the City of Wept Memphis, therefore,
an emergency is hereby declared to exist and this ordinance shall
be in full force and effect from and after its passage and
approval.
