AN ORDINANCE GRANTING A SPECIAL PERMITTED USE FOR A REAL ESTATE
BROKER OFFICE AND PLUMBING CONTRACTOR OFFICE ON THE PROPERTY
LOCATED AT 214, 216, & 218 North Fifth Street, ALSO KNOWN AS
LOTS 17, 18, & 19, BLOCK 6, THOMPSON THIRD ADDITION SUBDIVISION,
WEST MEMPHIS, ARKANSAS, DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES.
WHEREAS, Application was made to the City Planning
Commission of West Memphis, Arkansas, to allow a Special
Permitted Use of the hereinafter described lands for the
development of a Real Estate Broker Office and Plumbing
Contractor Office (per Zoning Ordinance No. 1258, as
amended); and.
WHEREAS, Notice of said hearing has been published for
the time and in the manner as provided by Ordinance No. 1258,
the matter was heard by the City Planning Commission on
July 5, 1995, and upon the matter being heard by the City
Planning Commission recommended that said Application be
granted provided the following stipulations were agreed upon
by the Applicant, to wit:
(1) That a min 6'--8' wood fence be constructed
around the rear of the property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
SECTION I: That the following described property, to wit:

Lots 17, 18, 19 `
Block 6
Thompson Third Addition Subdivision
be, and the same is hereby, granted a Special Permitted Use
allowing and permitting the use of the aforedescribed property
for the development of a Real Estate Broker Office and
Plumbing Contractor Office thereon in a C-1 General Business
District.
SECTION II: That all Ordinances or parts of Ordinances
in conflict herewith are hereby repealed.
SECTION III: EMERGENCY CLAUSE: It is found and declared
by the City Council of the City of West Memphis that this
property is in the process of further development and use and
this ordinance must be effective immediately in order that the
developer may begin and complete construction before inclement
weather begins and arrange financing while rates are down, and
that this ordinance is necessary for the orderly growth and
expansion of the City of West Memphis and for the protection of
the safety and welfare of the inhabitants of the City of West
Memphis, therefore, an emergency is hereby declared to exist
and this ordinance shall be in full force and effect from and
after its passage and approval.
