AN ORDINANCE WAIVING COMPETITIVE BIDDING, ESTABLISHING AN
EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows
waiving of competitive bidding in exceptional situations where such
procedure is deemed not feasible or practica?_; and
WHEREAS, there are many items necessary for the City's use
where competitive bidding is deemed not feasible or practical; and
WHEREAS, the West Memphis Police Department and the West
Memphis City Jail are in need of roofing rer?ir work due to rapid
deterioration of the roof in certain departments, and competitive
bidding under such circumstances would not be feasible or
practical;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived f;,r the following item
to be used by the City, described as follo•,~s:
Roofing repair work at the West Memphis Police Department and
West Memphis City Jail at a cost estimated not to exceed
$25,000.00.
2. EMERGENCY CLAUSE. It having been found and determined by
the City Council of the City of West Memphis, Arkansas, that there
is an urgent need by the West Memphis Police Department and the
West Memphis City Jail to have roofing repair work done immediately
due to rapid deterioration in certain departments, including the
communications department and has interfered with the functions, an
emergency is hereby declared to exist, and this Ordinance being
necessary for the preservation of the public beace, health, safety
and welfare of the citizens of West D:emp::is, Arkansas, shall be in
full force and effect from and after the date of its passage and
approval.
