May 3, 2012 MINUTES WEST MEMPHIS CITY COUNCIL MAY 3, 2012 A regular meeting of the West Memphis City Council was held on Thursday, May 3, 2012 at 1:30 p.m. in the City Council Chambers at City Hall, 205 S. Redding,West Memphis, Arkansas. Mayor Johnson called the meeting to order at 1:30 p.m. Invocation was given by Reverend David Moseley of the First United Methodist Church. Phillip Para, City Clerk, called the roll. Those present were: Mayor William H. Johnson, City Attorney David Peep/es, City Treasurer Frank Martin and Councilors, James Holt, Phi/lip Carter, Lorraine Robinson, James Pulliaum, Ramona Taylor, Herman Coleman, and Marco McClendon. Absent were: Councilmen: Willis Mondy, Taz Tyrone and Tracy Catt. Quorum being present, Mayor Johnson proceeded with the meeting. PROCLAMATION Mayor Johnson presented a Proclamation to Councilwoman Lorraine Robinson on behalf of the Keep America Beautiful, Inc. and proclaimed Saturday, May 5, as the Keep America Beautiful and the Great American Clean- Up Day in West Memphis. Mayor Johnson thanked Councilwoman Robinson for all of her time and effort put into this project. MINUTES Councilman Pulliaum made a motion, seconded by Councilwoman Taylor to dispense with the reading of the minutes of the April 19, 2012 City Council Meeting and approve them as submitted. Upon voice vote,the voting was unanimous to approve. OLD BUSINESS 2nd Reading AN ORDINANCE APPROVING THE HIRING OF LISA SUGGS D/BiA LISA'S PERFECT PAWS FOR DOG GROOMING FOR THE CITY OF WEST MEMPHIS,AND FOR OTHER PURPOSES City Attorney Peeples read the Ordinance for the SECOND time. Councilwoman Taylor made a motion, seconded by Councilman Holt to suspend the rules and place the Ordinance on the third reading. Upon voice vote,the voting was unanimous. City Attorney Peeples read the Ordinance for the THIRD and FINAL TIME. Councilwoman Taylor made a motion, seconded by Councilman Pulliaum to approve the Ordinance. Upon voice vote,the voting was unanimous. The Ordinance was adopted and assigned No. 2298. NEW BUSINESS Councilman Pulliaum made a motion, seconded by Councilwoman Taylor to suspend the rules and read the titles only of 0-1 and 0-2. Upon voice vote,the voting was unanimous to approve. R-1 A RESOLUTION EXPRESSING THE WILLINGNESS OF THE CITY OF WEST MEMPHIS TO UTILIZE FEDERAL-AID MONIES FOR THE FOLLOWING PROJECT: RECONSTRUCTION OF SOUTHLAND DRIVE FROM INGRAM BOULEVARD TO THE EAST(WEST MEMPHIS) City Attorney Peeples read the Resolution. Councilwoman Taylor made a motion, seconded by Councilwoman Robinson to approve the Resolution. Upon voice vote,the voting was unanimous to approve. The Resolution was adopted and assigned No. 2004. 0-1 AN ORDINANCE TO AMEND ZONING ORDINANCE 1988, AS AMENDED, IN REGARDS TO PERMITTED USES IN A C-2,COMMERCIAL DISTRICTS,ARTICLE III,SECTION 2, PARAGRAPH B, NUMBER(2) INDUSTRIAL USES PERMITTED IN A C-2 COMMERCIAL DISTRICT,AND PARAGRAPH C, LOT, YARD, AND HEIGHT REGULATIONS, FOOTNOTE(b) ,AND FOR OTHER PURPOSES City Attorney Peeples read the Ordinance for the FIRST time. PERMISSION REQUESTS Inspector Shelton of the West Memphis Police Department requested City Council approval of the City Emergency Response Plan, Annex D Revisions. He addressed the revisions of the plan and said the only changes made were the rank structure of the West Memphis Police Department. Due to the police department not having an Assistant Chief now, this changes that rank and inserts other ranks. Councilman Coleman made a motion, seconded by Councilwoman Taylor to table until the next City Council Meeting to give them time to review the revised plan. Upon voice vote, the voting was unanimous to table. Councilman Pulliaum made a motion, seconded by Councilwoman Taylor to approve the Planning Commission Recommendations as presented in the packets. Upon voice vote,the voting was unanimous to approve. (See attached) Next, Paul Luker introduced Jennifer Watkins, a consultant with Building Communities, Inc. She gave a Power Point Presentation regarding West Memphis partnership with the East Arkansas Regional Planning & Development District called "A Partnership for Sustainable Communities Project". Our Region consists of 12 Counties. She explained the project components and the project timeline, and requires community involvement. (See attached hard copy of the presentation) COMMITTEE REPORTS PUBLIC WORKS COMMITTEE—Councilwoman Taylor reported after the last Council meeting April 19th they approved the low bid for the striping project for$20,750.00. They met again May 1st and she reported that they approved the Resolution that was on the agenda today for council approval for the funding for the Southland Drive, Phase II Project. This will finish out Southland Drive from Ingram to Martin Luther King Jr. Drive.This project is expected to be approximately 2.7 million dollars with an 80/20 % matching grant. The city's portion will be around $575,000 and will be paid out of the Street Department Budget. The Sanitation Department fulfilled the contract to remove 3000 tires from the city. They discussed the problem of people dumping tires and would like to see a program implemented to help with this growing problem. They discussed the need for a Code Enforcement Officer. In other business Phillip Sorrell,City Engineer updated them on several projects: Ingram Blvd final pavement should be poured Monday, the plans for the striping project are being reviewed and a work order should be issued within the next two weeks. The Signalization Project is being rebid this month by the Highway Department. The Street Department has been utilizing the ditch cleaner that they rented. They also discussed the problem of beaver dams and approved the request from staff to hire a trapper to remove the beavers from the problem area. Mr. Sorrell reported the fence has been taken down on 14th Street right-of-way. The City is to maintain the property now. It was suggested that the Alderman from that Ward look into the possibility of closing the alley or finding another solution to the problem. Councilwoman Robinson reminded everyone that Saturday is clean up West Memphis registration is at 8:00 a.m. and they are cleaning until noon. She encouraged everyone to get involved. CITIZENS REQUESTS Tia Handy Dobbins—304 W. Jefferson - She said the NAACP will be joining in on the clean-up efforts this Saturday. She also spoke against the issue of censoring the Citizens Requests portion of the City Council Meeting. She said this was a violation of the FCC regulations. She asked that they reconsider taking Citizens Requests out the taping of the City Council meetings. Shabaka Africa said he agreed with Ms. Dobbins and feels it is a censorship and appears to be politically motivated. He announced that today at 6:30 p.m.,the Crittenden County NAACP is sponsoring a political forum at the Roberta Jackson Neighborhood Center. Finalists of the Black History Essay Contest will be moderators. Having no further business to come before the City Council, Councilwoman Taylor made a motion, second by Councilwoman Robinson to adjourn. Upon voice vote,the voting was unanimous.
