AN ORDINANCE ACCEPTING THE ANNEXATION OF CERTAIN TERRITORY
TO THE CITY OF WEST MEMPHIS, ARKANSAS, AND MAKING SAME A PART
OF THE CITY OF WEST MEMPHIS, ARKANSAS, AND ASSIGNING SAME TO WARD
WHEREAS, a Petition was filed with the County Clerk of

Crittenden County, Arkansas, by the majority of the real estate
owners of the hereinafter described territory praying that said
territory be annexed to, and made a part of the City of West
Memphis, Arkansas; and,
WHEREAS, on the 12th day of November, 1990, the County Court
of Crittenden County, Arkansas, found that the Petition was signed
by a majority of the real estate owners in said territory; that
said territory was contiguous and adjoining the present corporate
limits of the City of West Memphis; that an accurate plat or map
of said territory had been filed with and made a part of said
Petition; that proper notice had been given for the time and in the
manner prescribed by law, and that all things pertaining thereto
had been done in the manner prescribed by law, and that said lands
and territory should be annexed to and made a part of the City of
West Memphis, Arkansas, subject to the acceptance of same by the
City Council of said City at the proper time, as provided by law;
and,
WHEREAS, the time fixed by law for appealing from said Order
of Annexation made by the County Court has expired, and no appeal
has been taken from said Order.
NOW, THEREFORE, be it ordained by the City Council of the City
of West Memphis, Arkansas:

Section 1. That the following described lands and territory
contiguous and adjoining the City of West Memphis, Arkansas, be and
the same is hereby accepted as part of and annexed to and made a
part of the City of West Memphis:

70.68 acres lying in the SW 1/4, Section 15 and the NW
1/4, Section 22, T-6-N, R-8-E, Crittenden County,
Arkansas, more particularly described as follows:
Commencing at the center of Section 15, T-6-N, R-8-E,
Crittenden County, Arkansas, thence South 1250.4 feet
along the East line of the SW 1/4 of Section 15 to the
point of beginning; thence West 898.0 feet along the
existing city limits, thence South 3425.79 feet along the
existing city limits to a point on the North line of the
United Refrigerated Services, Inc. property; thence East
along said property line a distance of 898.0 feet to a
point on the centerline of Airport Road, thence North
along the centerline of Airport Road a distance of
3425.79 feet to the point of beginning, containing 70.68
acres, more or less.
Section 2. That the above described territory shall be
annexed to and made a part of Ward one of the City of West
Memphis, and the same shall henceforth be a part of said Ward as
fully as existing parts of said Ward.

appears by its attorney, William C. Ayres, and the City of West
Memphis, Arkansas, appears by its attorney, David C. Peeples.
WHEREUPON, this cause is heard upon the Petition for Annexation,
the Order Granting Annexation of November 12, 1990, the record
herein, and other matters and things before the Court, from all of
which the Court, being advised in the premises, finds:

The allegations of the Petition filed herein are sustained by
the proof, and in particular, that the Petitioners are the owners
of the real estate described in the Petition; that the limits of
the territory requested by the Petitioners to be annexed to the
City of West Memphis, Arkansas, are accurately described; that an
accurate map or plat of the territory requested by the Petitioner
to be annexed to the City of West Memphis, Arkansas, has been filed
herein, and the prayer of the Petitioners is right and proper.

ORDER GRANTING ANNEXATION
On the 12th day of November, 1990, came on to be heard the
Petition of Connecticut Mutual Life Insurance Company and City of
West Memphis, Arkansas, for annexation of certain territory to the
City of West Memphis, Arkansas, and from the Petition and other
papers filed herein, statements of counsel, and other matters and
things before the Court, the Court doth find:
I.
The Court has jurisdiction of the subject matter and of the
petition filed herein.
II.
That this hearing date is not less than thirty (30) days after
the filing of the Petition asking for such annexation; that between
the time of the filing of the Petition and the date of this
hearing, the Petitioner has caused notice to be published in the
Evening Times, a newspaper published in Crittenden County,
Arkansas, and having a general circulation in said County, once a
week for three consecutive weeks.
III.
The notice published contains the substance of the Petition
filed in this matter and also the time and place fixed by this

IT IS FURTHER ORDERED that no further action be taken herein
for a period of thirty (30) days as provided by law to allow the
institution of proceedings to prevent such annexation if any party
should desire to take such action under the provisions of the laws
of this State and, accordingly, this cause is continued until the
14th day of December, 1990, for further appropriate action as
provided by law.

NOTICE OF HEARING ON PETITION FOR ANNEXATION
Notice is hereby given that a Petition has been filed in the
County Court of Crittenden County, Arkansas, to have the following
lands, located in Crittenden County, Arkansas, to-wit:
70.68 acres lying in the SW 1/4, Section 15 and the NW
1/4, Section 22, T-6-N, R-8-E, Crittenden County,
Arkansas, more particularly described as follows:
Commencing at the center of Section 15, T-6-N, R-8-E,
Crittenden County, Arkansas, thence South 1250.4 feet
along the East line of the SW 1/4 of Section 15 to the
point of beginning; thence West 898.0 feet along the
existing city limits, thence South 3425.79 feet along the
existing city limits to a point on the North line of the
United Refrigerated Services, Inc. property; thence East
along said property line a distance of 898.0 feet to a
point on the centerline of Airport Road, thence North..,
along the centerline of Airport Road a distance of
3425.79 feet to the point of beginning, containing 70.68
acres, more or less.

City of West Memphis, Arkansas, signed the Petition by and through
their attorneys and are the owners of all of the lands in the
effected area.
The Petition requests that said lands be annexed to and become
a part of the City of West Memphis, Arkansas.
The Petitioners have nominated William C. Ayres of Saxton &
`' Ayres, Attorneys, West Memphis, Arkansas, and David C. Peeples,
West Memphis City Attorney, West Memphis, Arkansas, to act in the
matter.
By Order of the County Court entered on the 2 ~ day of

1990, at 10:00 a.m. has been set as a date for hearing said
Petition and the Clerk ordered to publish notice of said hearing.
All persons are hereby notified that a hearing on said

Comes now Connecticut Mutual Life Insurance Company and City
of West Memphis, Arkansas, and to the Court state:
I.
That Petitioners are the owners of the following described
lands located in Crittenden County, Arkansas, to-wit:
70.68 acres lying in the SW 1/4, Section 15 and the NW
1/4, Section 22, T-6-N, R-8-E, Crittenden County,
Arkansas, more particularly described as follows:
Commencing at the center of Section 15, T-6-N, R-8-E,
Crittenden County, Arkansas, thence South 1250.4 feet
along the East line of the SW 1/4 of Section 15 to the
point of beginning; thence West 898.0 feet along the
existing city limits, thence South 3425.79 feet along the

That the foregoing is a correct description of said lands, and
that the Plat attached hereto as Exhibit "A" and made a part of
this Petition by reference, is an accurate plat of said lands,
showing township and range in which said lands are situated.
III.
That the Petitioners own all of the acreage effected.
IV.
That said lands are contiguous to and adjoin the City of West
Memphis, Arkansas, and Petitioners desire that said lands be
annexed to and become a part of the City of West Memphis. Further,
said lands are adaptable to and needed for prospective municipal
purposes.
V.
The Petitioners nominate, constitute and appoint William C.
Ayres of Saxton & Ayres, Attorneys, West Memphis, Arkansas, and
David C. Peeples, West Memphis City Attorney, West Memphis,
Arkansas, to act for them in the prosecution of this action.
WHEREFORE, PETITIONERS PRAY THAT a date be set for hearing on
this Petition; that the Court order the Clerk to publish a notice
of the hearing on the Petition; and that upon final hearing the
corporate limits of the City of West Memphis, Arkansas, be extended
to include the lands hereinabove described.
