ORDINANCE NO. _~~~
AN ORDINANCE WAIVING COMPETITIVE BIDDING,
ESTABLISHING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Cade 14-58-303 allows waiving of
competitive bidding in exceptional situations where such
procedure is deemed not feasible or practical; and
WHEREAS, there are many items necessary for the City's
use where competitive bidding is deemed not feasible or
practical; and
WHEREAS, the West Memphis Utility Com~rzission has
recommended the purchase of a i.zsed excavator for a price of
$58,000.00 and the trade i.n of a 1974 model H560C Insley,
valued at $5,000.00, which equipment is needed for
immediate use and competitive bidding under such
circumstances would not be feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following
item to be used by the City, described as follows:
A used 690LC John Deere excavator, serial. # 514242, for
the purchase price of $58,000.00 together with a trade
in of 1974 model H560C Insley, valued a.t $5,000.00.
2. Emer~encv Clause. It having been found and
determined b;v the City Council of the City of West Memphis,
Arkansas, that there is an urgent need by the City of West
Memphis and the West Memphis Utility Commission to acquire
excavation equipment for use in ongoing projects, arz

emergency is hereby declared to exist., and this Ordinance
being necessary for the preservation of the public peace,
health, safety and welfare of the Citizens of West Memphis,
Arkansas, shall be in full force and effect from and after
the date of its passage. and approval.
