AN ORDINANCE ADOPTING BY REFERENCE THE STANDARD
MECHANICAL CODE, 1988 EDITION WITH ALL AMENDMENTS AND
REVISIONS THEREOF, DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES
WHEREAS, three copies of the Standard Mechanical Code, 1988
Edition, with all amendments and revisions, have been and are
now filed with the office of the City Clerk; and
WHEREAS, notice of the filing of copies of the Southern
Mechanical Code, 1988 Edition, with a,ll amendments and
revisions, has been duly published;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS, ARKANSAS:
SECTION 1. There is adopted by the City for the purpose of
establ_ishi_ng rirl_es and regulations applicable to the
installation of mechanical systems, including alterations,
fixtures, fittings and/or appurtenances thereto, including
ventilating, heating, cooling, air conditioning and
refrigeration systems, incinerators, and other energy related
systems, all of the Standard Mechanical Code, 1988 Edition and
all. amendments and revised editions thereof, save and except
such portions as are hereinafter deleted, modified or amended,
of which not less than three copies have been and are now filed
in the office of the City Clerk.
SECTION 2. Section 101.1 of the Standard Mechanical Code,
1988 Edition, as amended, is hereby amended to read as follows:
There is hereby established within the Department of
Planning and Development a sub-department to be called the
Mechanical Department and the person in charge shall be
known as the Mechanical. Official. No person shall be
appointed as Mechanical Official who has not had at least
five i51 years experience as a Plumbing or Mechanical
Inspector, or as a Superintendent, Foreman, or competent
mechanic in charge of mechanical construction.
SECTION 3__ No provision. of this ordinance is intended to
repeal anv provision of the Fire ~?revention Code or. the Southern
Standard Building Code of the City of West Memphis, Arkansas,
and this ordinance shall be construed to
be in addition to the standards required in said codes.
SECTION 4. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
SECTION 5_ EMERGENCY- CLAUSE. It being found and determined
by the City Council of the City of West Memphis, Arkansas, that
this Ordinance is necessary 1.o insure the safe installation of
mechanical devices within the City of West Memphis, Arkansas,
and it being further necessary for the preservation of the
public peace, health, safety, and welfare of the citizens of the
City of West Memphis, Arkansas, an emergency is hereby declared
and the provisions of this Ordinance shall be in full force and
effect from and after the date of its passage and approval.
