WHEREAS, The City of West Memphis under date of September 2, 1947,
received a certain easement from the Federal Compress, and
ti.... WHEREAS, One of the provisions was as follows:
"With the further right vested in the City of West Memphis,
Arkansas, to use said property for such other utility ease-
ments as they may from time to time deem necessary. " And
WHEREAS, certain conditions having existed, it is advisable to delete
this particular clause and insert the following:
" with the exception, that there shall be no construction above
the surface by the City of West Memphis, its successors and
assigns across that certain parcel ''A-1" said parcel being
shown on a portion of a plat dated August 2, 1977, and entitled
Parcels "A-1" and "A-2", same being drawn by Ellis, Fanning,

it Oakley, Chester and Rike, same being attached hereto and
Sir marked "Exhibit A" dated this Sixth day of October, 1977.
THEREFORE, BE IT RESOLVED, That the City grant this exception
giving Lol, ' S the following right , UCCESSORS TO FEDERAL COMPRESS.
"There shall be no construction above the surface by the City
of West Memphis, its successors and assigns across that
certain parcel "A-1, said parcel being shown on a portion of
a plat dated August 2, 1977, and entitled parcels "A-i and A-2",
drawn by Ellis, Fanning, Oakley, Chester and Rike, and attached
hereto.
