AN ORDINANCE WAIVING COMPETITIVE BIDDING,
ESTABLISHING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code 14-58-3Q3 allows waiving of
competitive bidding in e~~ceptional. sitzia.tions where such
procedure is deemed not feasible or practical; and
WHEREAS, there are many items necessary for. the City's
zzse where competitive bidding is deemed not feasible or
practical; and
WHEREAS, the West ^•femphis Advertising and Promotion
Commission. has recommended contracting with the West
Memphis Chamber Commerce for services related to tourist
related events; and
WHEREAS, the West Memphis Chamber of Commerce is
uniquely situated f°or providing services sought by the West
Memphis Advertising and Promotion Commission and competive
bidding under such circumstances would not be feasible or
practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following
item t,o be used by the City>, described as follows:
Contract for tourist rE~lated services between the West
Memphis Advertisin and Promotion Commission and. the
West Memphis Chamber of Commerce.
2. E_m_ez~_~nc~-_, Cl~zttse. It having been found and
determined k;y the City Counci_t of the City of West Memphis,
Arkansas, that there i.s an urgent need br~ the City of West
Memphis and the West Memphis Advertising a.nd Promotion
Commission the contract for tourist related services, an
emergency is hereby declared t,o e~i.st, and this Ordinance
being necessary for the preservation of the public peace,
health, safety and welfare of the Citizens of West Memphis,
Arkansas, shall be in full force and effect from and after
the date of its passage and approval..
