AN ORDINANCE GRANTING A SPECIAL PERMIT USE OF LOT 13 BLOCK
182-KENDAL SUBDIVISION; 111 SO. 23RD ST., AND DECLARING AN
EMERGENCY;
WHEREAS, application has been made to the City Planning Com-
mission to allow a Special Permitted Use of a Custom Decorative
Wrough Iron Plant Stand production facility in a C-2 Commercial
District, as required by Ordinance 1258, as amended.
WHEREAS, After Notice had been published for the time and in
the manner as provided by Ordinance No. 1258, as amended, the
matter was heard by the City Planning Commission and the Planning
Commission recommended that a Special Permit Use be granted to
said property to permit a Custom Decorative Wrough Iron Plant
Stand production facility in a C-2 Commercial District subject to
the special conditions as follows:
1.) No production be allowed on Sunday.
2.) Truck and vehicle parking must be off street.
3.) Screening must be installed to hide dumpster or trash
receptacle area.
4.) Outdoor storage of material must be handled to prevent
unsightly or unsanitary conditions.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
SECTION I: That the following described property, to-wit:
Lot 13 Block 182-Kendal Subdivision, 111 So. 23rd St.

be, and the same hereby is granted a Special Permit Use permit-
ting the usage of a Custom Decorative Wrough Iron Plant Stand
production facility with special conditions as follows:
1.) No production be allowed on Sunday.
2.) Truck and vehicle parking must be off street.
3.) Screening must be installed to hide dumpster or trash
receptacle area.
4.) Outdoor storage of material must be handled to prevent
unsightly or unsanitary conditions.
SECTION II: That all Ordinances or part of Ordinances in

conflict herewith are hereby repealed.
SECTION III: That it has been found and determined by the
City Council of the City of West Memphis, that this property is
presently being used as a Custom Decorative Wrough Iron Plant
Stand production facility and made available for public use and
'~, immediate passage of this Ordinance is necessary for the
development and use of said property for the purpose of a Custom
~ Decorative Wrough Iron Plant Stand production facility. That the
Council is of the opinion that the passage of the same is
necessary for the growth and expansion of the City of West Mem-
phis, Arkansas, and in the interest of the public health, peace,
safety and welfare of the City of West Memphis and the inhabi-
tants thereof. Therefore, an emergency is hereby declared to
exist and this Ordinance shall take effect and be in full force
and effect immediately upon its passage and approval.
