ORDINANCE NO.
AN ORDINANCE TO AMEND ARTICLE III, SECTION 2-B
PERMITTED USES OF ORDINANCE 1258, AS AMENDED, TO
ALLOW TIRE RECAPPING BSTABLISHMENTS IN C-1 AND C-2
DISTRICTS WITH A SPECIAL PERMIT USE, DECLARING AN
EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, after public hearing upon due notice and
publication, pursuant to Article IX Sections 5, 6 and 7 of
the zoning regulations adopted by Ordinance 1258, as
amended, the Planning Commission has approved and
recommended for adoption the proposed amendment to the
zoning regulations adopted by Ordinance 1258, as amended,
to allow tire recapping in C-1 and C-2 Commercial Districts
with a Special Permit Use.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
SECTION 1. Article III, Section 2-B of the zoning
regulations adopted by Ordinance 1258, as amended, is
hereby amended to add the following designation to allow
tire recapping establishments in C-1 and C-2 Commercial
Districts with a Special Permit Use:

SECTION 2. ~er~tenc~ Clause. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there is an urgent need by the City of West
Memphis to proceed with amending the zoning regulations to
allow tire recapping establishments in C-1 and C-2
Commercial Districts with a Special Permit Use, an
emergency is hereby declared to exist, and this Ordinance
being necessary for the preservation of the public peace,
health, safety and welfare of the citizens of West Memphis,
Arkansas, shall be in full force and effect from and after
the date of its passage and approval.
SECTION 3. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
