ORDINANCE N0. ~~
AN ORDINANCE GRANTING A SPECIAL PERMIT USE OF LOTS 2 and 3,
BLOCK 3, THOMPSON SUBDIVISION TO THE CITY OF WEST MEMPHIS,
ARKANSAS 111-113 NORTH 12th; (AND DECLARING AN EMERGENCY).
WHEREAS, application has been made to the City Planning
Commission to allow a Special Permitted Use of a Tire Recapping
facility in a C-1 General Business District, as required by
Ordinance 1258, as amended.
WHEREAS, after Notice had been published for the time
and in~the manner as provided by Ordinance No. 1258, as amended,
the matter was heard by the City Planning Commission and the
Planning Commission recommended that a Special Permit Use be
granted to said property to permit the Tire Recapping facility in
the C-1 General Business District subject to the special
conditions as follows:
1. Site proof fence must be constructed and maintained
along north property line and not to be less than
six (6) feet in height.
2. All parking must occur on site and meet Ordinance
1258 as amended per package required.
3. Truck loading and unloading must occur on site.
(Street not to be blocked).
4. No article or material stored or offered for sale
in connection with the special permitted use shall
be stored or displayed outside the confines of the
Building.
5. Documentation of EPA approval for said Business must
be submitted to City Hall Building Officials for
record before Business License or Certificate of
Occupancy is issued.
6. No addition s hall occur unless approved by the Board
of Adjustment of the City of West Memphis. The owner
if allowed to build can not cover 50% (fifty percent)
of Lots 2 or Lot 3, Block 3 Thompson Subdivison and
must set back from North property line twelve (12)
feet as long as the structure north of this property
is for reside ntial use.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
SECTION I. That the following described property, to wit:
Lots 2 and 3, Block 3, Thompson Subdivision, to the City
of West Memphis, Crittenden County, Arkansas, (being
located at 111-113 North 12th Street)
be, and the same hereby is granted a Special Permit Use permitting
the usage of a Tire Recapping facility with the special conditions
as follows:
1. Site proof fence must be constructed and maintained
along north property line and not to be less than
six (6) feet in height.
2. All parking must occur on site and meet Ordinance
1258 as amended per package required.
3. Truck loading and unloading must occur on site.
(Street not to be blocked).

SECTION II: That all Ordinances or parts of Ordinances
in conflict herewith are hereby repealed.
SECTION III: That it has been found and determined by
the City Council of the City of West Memphis, that this property
is in the process of being the facility of a Tire Recapping «
facility and made available for public use and the immediate
passage of this Ordinance is necessary for the developement and use
of the said property for the purposes of a Tire Recapping
facility. That the Council is of the opinion that the passage of
the same is necessary for growth and expansion of the City of West
Memphis, Arkansas, and in the interest of the peace, safety and
welfare of the City of West Memphis and the inhabitants therof.
Therefore, an emergency is hereby declared to exist and this
Ordinance shall take effect and be in full force and effect
immediately upon its passage and approval.
