ORDINANCE NO. ~H9© AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR THE RELOCATION OF WATERLINES IN CONNECTION WITH ONGOING DRAINAGE PROJECTS, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive bidding in exceptional situations where such procedure is deemed not feasible or practical; and WHEREAS, the City of West Memphis has drainage projects under construction which require the relocation of waterlines, which work was originally to be performed by the West Memphis Utility Commission; and WHEREAS, the drainage project is being constructed by Four F Construction and scheduling conflicts have made it difficult to coordinate the work by the West Memphis Utility Commission to relocate the waterlines as construction proceeds on the drainage projects and it would be more feasible and practical to coordinate this work by having the waterlines relocated and the drainage project constructed by the same construction crew and that competitive bidding for such work under such circumstances would not be feasible or practical; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS, ARKANSAS: 1. That competitive bidding be waived for the following services to be used by the City, described as follows: The relocation of waterlines by Four F Construction in connection with the Landside Berm and Drainage Improvement at a price not to exceed $16,400.00. 2. It having been found and determined by the City Council of the City of West Memphis, Arkansas, that there is an urgent need by the City of West Memphis to coordinate efforts to relocate waterlines in connection with ongoing drainage projects in the City of West Memphis and that it is not feasible or practical to conduct competitive bidding for such services and that time is of the essence, an emergency is hereby declared to exist, and this Ordinance being necessary for the preservation of the public peace, health, safety and welfare of the citizens of West Memphis, Arkansas, shall be in full force and effect from and after the date of its passage and approval.
