AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO JACK D. McCLAIN,
FOR THE PROPERTY LOCATED AT 901 EAST POLK, ALLOWING A DAYCARE
FACILITY IN A R-4, MEDIUM DENSITY RESIDENTIAL DISTRICT.
WHEREAS, application has been made to the City Planning Commission for a
Special Use Permit allowing a daycare facility in a R-4, Medium Density Residential District,
as required by Ordinance 1988, as amended.
WHEREAS, after notice had been published for the time and in the manner as provided
by Ordinance No. 1988, as amended, the matter was heard by the City Planning Commission on
May 25, 2005 and the Planning Commission recommended that a Special Use Permit be
granted to allow a daycare faciltity at 901 East Polk, located in a R-4, Medium Density
Residential District, with the following criteria:
Put up a sign to notify customers to discharge children North bound on S. 9th
Street.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNSEL OF THE
CITY OF WEST MEMPHIS ARKANSAS:
SECTION 1: That the following described property, to wit:
901 East Polk
Lots 1, 2, and 3, Block 106
Kendal Subdivision
and the same hereby is granted a Special Use Permit allowing a daycare facility at 901 East Polk,
located in a R-4, Medium Density Residential District, with the following criteria:
Put up a sign to notify customers to discharge children North bound on S. 9th
Street.
SECTION II: That all ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
