AN ORDINANCE TO AMEND ARTICLE 111, SECTION 2-B
PERMITTED USES OF ORDINANCE 1258, AS AMENDED, TO ALLOW
LIMITED ACCESSORY USE APARTMENTS IN O-1 OFFICE
DISTRICTS AND IN C-1 AND C-2 COMMERCIAL DISTRICTS, AND
FOR OTHER PURPOSES.
WHEREAS, after public hearing upon due notice and
publication, pursuant to Article IX Sections 5, 6 and 7 of
the zoning regulations adopted by Ordinance 1258, as
amended, the Planning Commission has approved and
recommended for. adoption the proposed amendment to the
zoning regulations adopted by Ordinance 1258, as amended,
to allow limited accessory izse apartments in O-1 Office
Districts and in C-1 and C-2 Commercial Districts; and
WHEREAS, the City Council finds that the proposed
amendment to the zoning regulations of the City of West
Memphis should be adopted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Article III, Section 2-B of the zoning
regulations adopted by Ordinance 1258, as amended, is
hereby amended to add the following designation to allow
limited accessory use apartments in O-1 Office Districts
and in C-1 and C-2 Commercial Districts:

Apartments. Apartments or
apartment units that should be
considered an accessory to an
office or commercial use that
should be attached to and have
no more floor area than the office
or business space, but in no case
more than two (21 units be allowed
per building, office, or business
location. Require 1 1/2 parking
spaces per unit in addition to the
required parkingfor the office or
business.
SECTION 2. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
