AN ORDINANCE TO AMEND ARTICLE VIII OF THE LAND
SUBDIVISION AND DEVELOPMENT CODE OF THE CITY OF WEST
MEMPHIS, ARKANSAS, AS ADOPTED BY ORDINANCE 1266, AND
FOR OTHER PURPOSES.
WHEREAS, after a public hearing upon due notice and
publication, the Planning Commission approved and
recommended for adoption certain proposed amendments to the
Land. Subdivision and Development Code of the City of West
Memphis, Arkansas, adopted by Ordinance 1266; and
WHEREAS, the City Council finds that the proposed
amendments to the Land Subdivision and Development Code of
the City of West Memphis should be adopted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Article VIII of the Land Subdivision and
Development Code of the City of West Memphis, Arkansas, as
adopted by Ordinance 1266 is hereby amended to add the
following as Section 4.1:
Section 4.1 CLOSURE OF STREETS, ALLEYS OR EASEMENTS
A. A street, alley or easement may be closed by a.
written instrument, to which a copy of an approved
plat shall be attached, declaring the same to be
closed. Closure of a street, alley or easement
shall be subject to the approval of the City
Council located within the corporate limits, and
subject to the approval of the Quorum Court if
located outside the city limits but within the
planning jurisdiction.
B. Such an instrument shall be approved by the
Planning Commission in like manner as plats of
subdivisions. The City Council may reject any such
instrument which abridges or destroys any public
rights in any of its public uses, improvements,
streets, or alleys.

C. Such an instrument shall be executed,
acknowledged, or approved, and recorded or filed,
in like manner as plats of subdivisions; and shall
be duly recorded or filed.
SECTION 2. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
