2307 ORDINANCE NO. 3o7
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE RELOCATION
OF A WATER LINE AT THE INTERSECTION OF 7r" STREET AND EAST
BARTON AVENUE, DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS, there are many items necessary for the City's use where competitive bidding is
deemed not feasible or practical; and
WHEREAS, the West Memphis Utility Commission has to relocate a water line at the
intersection of 7'h Street and East Barton Avenue for road construction being performed, and Crittco
Cable and Fiber, Inc., has agreed to perform this work for the amount of$47,100.00, and competitive
bidding under such circumstances would not be feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the relocation of a water line at the intersection
of 7'h Street and East Barton Avenue.
2. That the proposal from Crittco Cable and Fiber, Inc.,to perform this work for the amount
of $47,100.00 be approved.
3. EMERGENCY CLAUSE. It having been found and determined by the City Council
of the City of West Memphis, Arkansas, that the relocation of the water line is necessary to move
forward with the road construction that is currently in progress and to refrain from any delays, an
emergency is hereby declared to exist,and this Ordinance being necessary for the preservation of the
public peace, health, safety and welfare of the Citizens of West Memphis,Arkansas, shall be in full
force and effect from and after the date of its passage and approval.
