AN ORDINANCE TO AMEND ORDINANCE 1062, DECLARING AN b~ oxtp'
EMERGENCY AND FOR OTHER PURPOSES. o~
WHEREAS, the City Council of the City of West Memphis
finds that the limitations provided in Ordinance 1062
unduly restrict the use of city parks, particularly with
regard to major tourist related events; and
WHEREAS, the use of city parks for major tourist
related events can provide many benefits to the City of
West Memphis; and
WHEREAS, the West Memphis Parks and Recreation
Commission controls the use of city parks;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
SECTION 1. Section 1 of Ordinance 1062 is hereby
amended to read as follows:
It shall be unlawful for any person or persons to sell,
consume, or possess any beverage with alcoholic content in
any of the public parks under the jurisdiction of the West
Memphis Parks and Recreation Commission, except by special
permit granted by the West Memphis Parks and Recreation
Commission. Except as may be provided by the West Memphis
Parks and Recreation Commission for public parks, it shall
be unlawful for any person or persons to sell, consume or
possess any beverage with alcoholic content on any property
owned by the City of West Memphis, however, such
prohibition shall not apply to any property subject to the
rules and regulations of the West Memphis Airport
Commission.
SECTION 2. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
SECTION 3. EMERGENCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,

Arkansas, that the authority granted herein will greatly
enhance the ability of city parks to attract major tourist
related events and that time is of the essence in this
matter, an emergency is hereby declared to exist, and this
ordinance being necessary for the preservation of the
public peace, health, safety and welfare of the citizens of
West Memphis, Arkansas, shall be in full force and effect
from and after the date of its passage and approval.
