AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR THE
PROFESSIONAL APPRAISAL OF PROPERTY REQUIRED FOR THE FLOOD
¢ PROTECTION PROJECT AND AUTHORIZING PAYMENT TO CREWS
APPRAISAL COMPANY, DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows
waiving of competitive bidding in exceptional situations where
such procedure is deemed not feasible or practical; and
WHEREAS, the City of West Memphis has required professional
appraisal services in connection with the acquisition of
property necessary for the Flood Protection Project; and
WHEREAS, the expense of professional appraisal services in
connection with the Flood Protection Project was not
anticipated to exceed the amount for competitive bidding; and
WHEREAS, competitive bidding for the professional appraisal
services necessary for the Flood Protection Project would not
have been feasible or practical in that time is of the essence;
and
WHEREAS, the City of West Memphis has contracted with Crews
Appraisal Company for the appraisal of property necessary for
the Flood Protection Project and Crews Appraisal Company has
submitted a statement in the amount of $7,500.00 for such
services;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following
services to be used by the City, described as follows:
""` Professional appraisal services in connection with the
~ acquisition of property for the Flood Protection Project.
and the payment in the amount of $7,500.00 to Crews Appraisal
Company for such services is hereby approved and authorized.
2. EMERGENCY CLAUSE. It having been found and determined by
the City Council of the City of West Memphis, Arkansas, that
there is a need by the City of West Memphis for professional
appraisal services in connection with the Flood Protection which
services have been performed and were not anticipated to exceed
the amount requiring competitive bidding and that it is not
feasible or practical to conduct competitive bidding for such
services under these circumstances and that time is of the
essence, an emergency is hereby declared to exist, and this
Ordinance being necessary for the preservation of the public
peace, health, safety and welfare of the citizens of West
Memphis, Arkansas, shall be in full force and effect from and
after the date of its passage and approval.
