WHEREAS, the Planning Commission of the City of West
Memphis, Arkansas, has prepared amendments to Ordinance 1258,
which adopted zoning regulations and an official zoning map for
~ the City of West Memphis, Arkansas; an
~ not fewer than three (3) copies of said amendments
,~lr- WHEREAS ,
to Ordinance 1258 have been on file in the office of the City
Clerk in the West Memphis City Hall and will continue to be on
file at all times for public inspection and review; and
WHEREAS, after a public hearing upon due notice and
publication, pursuant to Article IX, Sections 5, 6 and 7 of the
zoning regulations adopted by Ordinance 1258, the Planning
Commission has approved and recommended for adoption the
proposed amendments to the zoning regulations adopted by
Ordinance 1258;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:

SECTION 2. Article III, Section 1 (B)(2) of the zoning

regulations adopted by Ordinance 1258 is hereby amended with
respect to Community Facilities and Related Uses to add the
Special Permitted Use Classification of Groun Shelter with the
following requirement:

SECTION 3. Article V, Section 4 of the zoning regulations
adopted by Ordinance 1258 is hereby amended to read as follows:
A carnival, or similar temporary enterprise shall be
permitted only in a Commercial zoning district and
shall have no facilities located nearer to a
residential district than two hundred (200) feet and no
nearer to any occupied residential structure than five
hundred (500) feet and shall have access drives so
located as to minimize traffic hazards. The applicant
shall show that adequate measures will be taken to
prevent odor, dust, noise, lights, and traffic from
becoming a nuisance to uses on other adjacent
properties. Each Certificate of Occupancy for such an
enterprise shall be valid for a period of not more than
ten (10) days and shall not be granted for more than
three such periods for the same location within any 90-
day period.

SECTION 4. Article V, Section 4 of the zoning regulations
adopted by Ordinance 1258 is hereby amended to add the following
language for Church-Tent Revival:
Church Tent Revival, shall be permitted only in a
Commercial zoning district and shall have no facilities
located nearer to a occupied residential structure or
to a residential district than two hundred (200) feet,
and shall have access drives so located as to minimize
traffic hazards. The applicant shall show that
adequate measures will be taken to prevent odor, dust,
noise, lights and traffic from becoming a nuisance to
uses on other adjacent properties. Each Certificate of
Occupancy for such an enterprise shall be valid for a

SECTION 5. Article VI, Section I (B) of the zoning
regulations adopted by Ordinance 1258 is hereby amended with
respect to Application of Standards to add the following
requirements:
6. Parking in office, commercial and industrial zones
shall have a three (3) foot setback line from property
'"`~ line. The area between the setback line and the front
lot line shall be prepared and planted with grass,
shrubs, trees or other similar ground cover.
SECTION 6. Article X, Section 2 of the zoning regulations
adopted by Ordinance 1258 is hereby amended to add the following
terms and their definitions:
GROUP SHELTER:
A residence, operated by a public or private
legally approved non-profit organization which may
provide a program of services in addition to room and
board to persons on a voluntary basis under continuous
supervision.
SECTION 7. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
