AN ORDINANCB TO AMBND 3BCTION 2 OF ORDINANCB 977; DBCLARING
AN BMBRGBNCY AND FOR OTHBR PURP03B3.
WHBRBA3, Ordinance 977 of the City of Weat Memphis,
Arkansas, created a West Memphis Port Authority pursuant to the
authority of Act 910 of 1979 of the State of Arkansas; and
WHBRBA3, the power and authority of municipal port
authorities is set out in Arkansas Code Annotated Sections 14-
186-201, et. seq.
NOW, THBRBFORB, BB IT ORDAINBD BY THB CITY COUNCIL OF THB
CITY OF WB3T MBMPHI3, ARHAN3A3, THAT:
3BCTION 1. Section 2 of Ordinance 977 of the City of West
Memphis, Arkansas, which is codified as Section 2.42.010 of the
West Memphis Municipal Code is hereby amended to read as
follows:
There is hereby created under the provisions of Act 910 of
1979, of the State of Arkansas, a West Memphis Port
Authority, which shall have all of the power and authority
as set out in A.C.A. 14-186-201, et. seq.
38CTION 2. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
3BCTION 3. BMBRGBNCY CLAU3B. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there is an urgent need to amend Ordinance 977
of the City of West Memphis, Arkansas, to set out the scope of
the power and authority of the West Memphis Port Authority, an
emergency is hereby declared to exist, and this ordinance being
necessary for the preservation of the public peace, health
safety and welfare of the citizens of West Memphis, Arkansas,
shall be in full force and effect from and after the date of
its passage and approval.
