BSCTION 1. Section 3 of Ordinance 1501, codified as
Section 8.04.130 of the West Memphis Municipal Code, is
hereby amended to read as follows:
USERS FEES
There will be a users fee of twenty dollars ($20.00)
per cubic yard per container up to a maximum fee of one
hundred seventy five dollars ($175.00) per container for
the period of January 1st through December 31st of each
year for commercial pickup by a private firm.
Each container must be registered with the City Clerk's
Office which will issue a sticker which must be displayed
on each container in such a manner that it may be checked
by the utility meter readers. A fine of five hundred
dollars ($500.00) per container shall be charged, in
addition to the user's fee, if a container is found not
registered with the City Clerk.
. BMEIiaBNCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there is an urgent need by the City of West
Memphis to amend its garbage rates as a result of increased
landfill fees and that time is of the essence, an emergency
is hereby declared to exist, and this Ordinance being
necessary for the preservation of the public peace, health,
safety and welfare of the citizens of West Memphis,
Arkansas, shall be in full force and effect from and after
January 1, 1992 and shall apply to all billings after
January 1, 1992.
