AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR THE DISPOSAL
OF MATERIAL CONTAINING PCB, DECLARING AN EMERGENCY AND FOR
OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows
waiving of competitive bidding in exceptional situations where
such procedure is deemed not feasible or practical; and
~,, WHEREAS, the West Memphis Utility Commission has removed
certain material containing PCB and i.s in need of making proper
disposal of such material pursuant to the appropriate state and
federal regulations; and.
WHEREAS, competitive bidding for the disposal of such
material would not be appropriate under these circumstances due
to the strict state and federal regulations and the potential
liability associated therewith; anc~
WHEREAS, time is of the essence in order_ to properly dispose
of such material, it would not be feasible or practical to
conduct competitive bidding for such services i.rnder such
circumstances;
1 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following
services to be used by the City, described as follows:
The disposal by APTUS of material containing PCB in an
amount up to $22,500.00.
2. EMER.GENCY_CLAUSE. It having been found and determined
by the City Council of the City of West Memphis, Arkansas, that

they<.~ is a need by the City of West Memphis and the West Memphis
utility Commission. to properly- dispose of the above material in
compliance with applicable state and federal regulations and
that it is not feasible or practical to conduct. competitive
bidding for such item and. that time is of the essence, and
emergency is hereb,v declared to exist, and this Ordinance being
necessary for the preservation of the public peace, health,
safety and welfare of the citizens of West Memphis, Arkansas,
slrall be in fu.l..l. force anal effect from and after the date of its
passage and approval.
