2318 ORDINANCE NO. 231
AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR THE PURCHASE
OF MOTOR FUEL, AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS, there are many items necessary for the City's use where competitive bidding
is deemed not feasible or practical; and
WHEREAS, the price of motor fuel changes rapidly and suppliers are hesitant to quote
prices in advance and competitive bidding under such circumstances would not be feasible or
practical;
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following item to be used by the City,
described as follows:
Motor fuel purchases to be made by the Purchasing Agent,upon obtaining the lowest phone
bids when motor fuel is needed, provided the Purchasing Agent gets at least three (3)
separate bids and the bids be forwarded to the City Clerk to file with the Council minutes
showing the name of the lowest bidder. This ordinance shall be void twelve (12) months
after the date of passage.
