AN ORDINANCE TO WAIVE COMPETITIVE BIDDING, AND
FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows
waiving of competitive bidding in exceptional situations where
such procedure is deemed not feasible or practical; and
WHEREAS, the City of West Memphis is in need of purchasing
107.5 acres of surplus land from AP&L for the Flood Protection
Project in the amount of $3,000.00 per acre; and
WHEREAS, this specific piece of surplus land is available
from only one source and competitive bidding under such
circumstances would not be feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following
item to be used by the City, described as follows:
SEE ATTACHED LEGAL DESCRIPTION.
2. The Mayor and the City Clerk are hereby authorized to
execute any and all documents pertaining to the purchase of
certain real property on behalf of the City of West Memphis,
Arkansas.
