ORDINANCE NO. 15
AN ORDINANCE VACATING A PORTION OF THE ALLEY RUNNING
THROUGH BLOCK 6 OF WHEELER SUBDIVISION AND A PORTION
OF 20TH STREET, IN WEST MEMPHIS, ARKANSAS.
WHEREAS, a petition was duly filed with the City Council
of the City of West Memphis, Arkansas, on the 4th day of

r February, 1993, asking the City council to vacate a portion of
the alley running through Block 6 of the Wheeler Subdivision
and a portion of 20th Street in the City of West Memphis,
Arkansas, as hereinafter more particularly described; and
WHEREAS, after due notices as required by law, the City
council has, at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question and has
ascertained that the portions of the alley and street
hereinafter described have heretofore been dedicated to the
public's use; have not been actually used by the public
generally for a period for at least five years subsequent to
the filing of the plat whereby they were dedicated; that
petitioner is the sole owner of the property abutting upon the

portions of the alley and street to be vacated; and that
public interest and welfare will not be adversely affected by
the abandonment of such portions of said alley and street.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
Section 1. The City of West Memphis hereby releases,
vacates and abandons all its rights, together with the rights
of the public generally subject only to existing utility

easements, in and to the portions of the alley and street
described as follows:
(a) The 30-foot alley abutted on the north by
Lots 1, 2, 3, 4 and on the south by Lots 8, 9, 10,
and 11 in Block 6 of Wheeler Subdivision, West
Memphis, Arkansas, as shown by plat of record in
Plat Book 2 at pages 113 and 114, more particularly
described as beginning at the northwesterly corner
of said Lot 8, thence continue in a northerly
direction 30 feet to the southwesterly corner of
said Lot 4, thence easterly along the south line of
said Lots 4, 3, 2 and 1 to the west line of 20th
Street, thence south to the northeasterly corner of
said Lot 11, thence westerly to the point of
beginning;
(b) That part of 20th Street abutted on the
west by Lots 1 and 11 in Block 6 of the Wheeler
Subdivision as shown by the above plat and on the

the above plat, more particularly described as
beginning at the northeasterly corner of said Lot
11, thence east 60 feet to the west line of Lot 5 of
the Regency subdivision, thence north 230.48 feet
along the west line of said Lot 5 to the
northeasterly point of 20th street, thence 60 feet
west to the northeasterly corner of Lot 1 in Block 6
