AN ORDINANCE TO APPROVE A CONTRACT FOR THE PURCHASE
OF AN OPTION TO ACQUIRE CERTAIN PROPERTY FOR THE
WEST MEMPHIS MUNICIPAL AIRPORT, WAIVING COMPETITIVE
BIDDING, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, The West. Memphis Airport Commission has
negotiated with the Federal. Aviation Administration for
financial. assistance to acquire the real property described
in Exhibit "A" which is attached hereto and. incorporated
herein by reference; and
WHEREAS, it is anticipated that the federal funding
will be avai]_able in the near future; and.
WHEREAS, the West Memphis Airport Commission has
recommended that the City of West Memphis purchase an
option on said property' lIl order to be i.n a position for
the immediate acquisition and development of said property
upon the availability of federal funding;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
SECTION 1. The contr. act for the purchase of a twelve

month option to acquire the property desc:.ribed in Fsxhibit
"A" attached hereto, for the option contract price of
$7,500.00 which amount shall be applied toward the total
purchase price of $1,500.00 per• acre in the event the
option is exercised, is hereby approved and the Mayor and.
City Clerk are hereby aut.horiz.ed to execute such contract.
SECTION 2. Competitive bidding for the above described
purchase by the City of West Memphis is found to be not
feasible or practical for the reasons that this is a unique
item and is available from a sole source and, therefore,
pursuant to the provisions of Arkansas Code l~I-58-303, the
competitive bidding procedure is hereby waived.
SECTION 3. EMERGENCY CLAUSE. It having been found anal
determined by the City Council. of the City of West Memphis,
Arkansas, that there is an urgent need by the City of West
Memphis for the item described above for the orderly growth
and expansion of the West Memphis :Municipal Airport and to
make use of federal fundin<, at, the earliest date of
availability, an emergency is hereby declared to exist, and
this Ordinance being necessary for the preservation of the
public peace, health, safety and welfare of the Citizens of
West Memphis, Arkansas, shall be in full force and effect
from and after the date of its passage and approval.

Commencing at the center of Section 15, T-6-N, R-8-E, Crittenden County,
Arkansas; thence south along the east line of the southwest quarter (SW 4) of
Section 15 a distance of 1250.4 feet to the point of beginning; thence west a
distance of 898 feet along the existing airport property line; thence south a
distance of 3426.79 feet along the existing airport property line to the north-
west corner of the United Refrigerator Services, Inc. tract; thence east along
the north line of said tract a distance of 350.0 feet; thence north a distance of
2036.19 feet to a point on the north line of Section 22; thence east a distance
of 548.0 feet to the southeast corner of the southwest quarter of Section 15;
thence north a distance of 1389.6 feet along the east line of the Southwest
quarter to the point of beginning; containing 44.05 acres, more or less, lying
in the SW 4 of Section 15 and the NW 4 of Section 22, T-6-N, R-8-E, Crittenden
