ORDINANCE NO. _13~!
AN ORDINANCE TO WAIVE COMPETITIVE BIDDING, DECLARING AN
EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows
~ waiving of competitive bidding in exceptional situations where
such procedure is deemed not feasible or practical; and
WHEREAS, there are many items necessary for the City's use
where competitive bidding is deemed not feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARHANSAS:
1. That upon the recommendation of the West Memphis Utility
Commission, competitive bidding be waived for the hiring of Mr.
George Brower, Sc.D., P.E., to serve as the consultative
engineer for purposes of observing the testing of the aeration
equipment at the City's wastewater treatment plant and reporting
to the Utility Commission. Competitive bidding is being waived
for the reason that it is necessary to hire an independent
engineer acceptable to both the City and the the manufacturer of
the aeration equipment as soon as possible in order to begin
testing and competitive bidding under such circumstances would
not be feasible or practical.
2. Emer~encv Clause. It having been found and determined by
the City Council of the City of West Memphis, Arkansas, that
there is an urgent need by the City of West Memphis to proceed
with the testing of the aeration equipment at the wastewater
treatment plant and that an independent engineer will be
necessary to observe said testing, an emergency is hereby
declared to exist, and this Ordinance being necessary for the
preservation of the public peace, health, safety and welfare of
the Citizens of West Memphis, Arkansas, shall be in full force
and effect from and after the date of its passage and approval.
