AN ORDINANCE FOR THE ADOPTION OF THE NATIONAL
ELECTRICAL CODE, 1987 EDITION, PROVIDING PENALTIES FOR
VIOLATIONS OF SUCH REGULATIONS, DECLARING AN EMERGENCY
AND FOR OTHER PURPOSES.
BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
SECTION 1. There is hereby adopted by the City of West
Memphis, Arkansas, pursuant to Act No. 267 of the Acts of
the General Assembly of Arkansas, 1949, for the purpose of
establishing rules and regulations governing the use of
electricity for light, heat, power, radio signaling, and
for other purposes, the National Electric Code, 1987
Edition, of which not less than three (3) copies shall be
filed in the office of the Clerk of the City of West
Memphis, Arkansas, and same are hereby adopted and
incorporated as fully as if set out at length herein and
from the date on which this Ordinance shall take effect,
the provisions thereof shall be controlling within the City
Limits of the City of West Memphis, Arkansas.
SECTION 2. It shall be the duty of the Electrical
Inspector to see that this Code is enforced.
SECTION 3. ELECTRICAL WIRING.
(a) All electrical wiring No. 10 AWG and smaller installed
in the City of West Memphis, Arkansas, shall be copper
or copper-clad aluminum.
(b) No plain aluminum wire in these sizes shall be used.
SECTION 4. Any person, firm or corporation who shall
fail to comply with any of the provisions of this ordinance
shall be guilty of a Class A Misdemeanor, and upon
conviction thereof, shall be fined not less than Five
Hundred and No/100 ($500.00) Dollars nor more than One
Thousand and No/100 ($1,000.00) Dollars. If a thing
prohibited or rendered unlawful is in its nature continuous
in its respect to time, the fine or penalty for allowing
the continuance thereof, in violation of this Ordinance,
shall not exceed One Hundred and No/100 ( $100.00 ) Dollars G~~J~'OF~~'~'

SECTION 5. Ordinances numbered 751, 807, 825 and 120 of
the City of West Memphis, Arkansas, and all other
Ordinances or parts of Ordinances in conflict herewith are
hereby repealed.
SECTION 6. EMERGENCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there exists an urgent need to update the
City's Electrical Code, an emergency is hereby declared to
exist, and this ordinance being necessary for the
preservation of the public peace, health, safety and
welfare of the citizens of West Memphis, Arkansas, it shall
be in full force and effect from and after the date of
passage and approval.
