AN ORDINANCE TO AMEND SECTION 2.4 OF ORDINANCE NUMBER
1214 TO SET CERTAIN LIMITATIONS, DECLARING AN EMERGENCY
AND FOR OTHER PURPOSES.
WHEREAS, Section 2.4 of Ordinance 1214 established
certain limitations for the discharge of wastewater into
the City's sewer system; and
WHEREAS, Ordinance 1214 has been amended by Ordinance
1340, including Section 9 which amended Section 2.4 of
Ordinance 1214 to include additional limitations regarding
Biological Oxygen Demand, Total Suspended Solids and Oil
and Grease, which additional limitations require prior
approval by the Arkansas Department of Pollution Control
and Ecology; and
WHEREAS, the additional limitations contained in
Section 9 of Ordinance 1340 were under consideration at the
time of the adoption of Ordinance 1340 but were
inadvertently included in Ordinance 1340 by clerical error
in the drafting of Ordinance 1340 prior to approval by the
Arkansas Department of Pollution Control and Ecology; and
WHEREAS, Section 2.4 of Ordinance 1214 should be
amended to read as it did prior to the adoption of
Ordinance 1340;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
SECTION 1. Section 2.4 of Ordinance 1214 is hereby
amended to read as follows:
No person shall discharge wastewater containing in
excess of:
Maximum 1-Dav 30-Dav Average
Arsenic 8.00 ppm 3.00 ppm
Cadmium 0.69 ppm 0.26 ppm
Copper 3.38 ppm 2.07 ppm
Cyanide 1.20 ppm 0.65 ppm
Lead 0.69 ppm 0.43 ppm
Mercury 0.05 ppm 0.03 ppm
Nickel 3.98 ppm 2.38 ppm
Silver 0.43 ppm 0.24 ppm
Total Chromium 2.77 ppm 1.71 ppm
Zinc 2.61 ppm 1.48 ppm
SECTION 2. Section 9 of Ordinance 1340 and all
ordinances or parts of ordinances in conflict herewith are
hereby repealed.

SECTION 3. EMERGENCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there is an urgent need to clarify the
limitations for discharges of wastewater into the City's
sewer system until such time as additional limitations are
approved by the Arkansas Department of Pollution Control
and Ecology, an emergency is hereby declared to exist and
this ordinance, being necessary for the preservation of the
public peace, health, safety and welfare of the Citizens of
the City of West Memphis, Arkansas, shall be in full force
and effect from and after the date of its passage and
approval.
