1376ORDINANCE NO. 131
AN ORDINANCE TO AMEND ORDINANCE 1359, DECLARING AN EMERGENCY
AND FOR OTHER PURPOSES.
WHEREAS, expenses for the purchase of materials, labor and
installation of fine air diffusers and related piping, wiring,
filters and related accessories as recommended by the project
engineer to be installed at the West Memphis Sewer Treatment
Plant have exceeded the original estimate of $160,000.00;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
1. Section 1 of Ordinance 1359 is hereby amended to read as
follows:
That upon the recommendation of the project engineer, Jerome
Alford of Bond Consulting Engineers, to the West Memphis
Utility Commission, competitive bidding be waived for the
purchase of materials, labor and installation of fine air
diffusers and related piping, wiring, filters and related
accessories as recommended by the project engineer to be
installed at the West Memphis Sewer Treatment Plant at a
total cost not to exceed $200,000.00. Competitive bidding is
being waived for the reason that time is of the essence in
complying with State and Federal environmental standards and
competitive bidding under such circumstances would not be
feasible or practical.
2. Emerrtenc~ Clause. It having been found and determined by
the City Council of the City of West Memphis, Arkansas, that
there is an urgent need by the City of West Memphis to acquire
the above described items to comply with State and Federal
environmental standards, an emergency is hereby declared to
exist, and this ordinance being necessary for the preservation
of the public peace, health, safety and welfare of the Citizens
of West Memphis, Arkansas, shall be in full force and effect
from and after the date of its passage and approval.
