AN ORDINANCE PERMITTING THE CITY TO PURCHASE PLANTS AND
FLOWERS FROM BUSINESSES OWNED OR OPERATED BY MEMBERS OF
THE CITY COUNCIL, DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES.
WHEREAS, in accordance with the provisions of Arkansas
Code 14-42-107 the City is prohibited from conducting
business with businesses owned or operated by aldermen
unless authorized by ordinance; and
WHEREAS, the City has a need to purchase plants and
flowers to be placed on City property;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS, ARKANSAS, THAT:
SECTION 1. The City of West Memphis is hereby
authorized to purchase flowers and plants from any business
owned or operated by any member of the City Council.
SECTION 2. EMERGENCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there is an urgent need by the City of West
Memphis to have the authority granted by this ordinance, an
emergency is hereby declared to exist, and this Ordinance
being necessary for the preservation of the public peace,
health, safety and welfare of the Citizens of West Memphis,
Arkansas, shall be in full force and effect from and after
the date of its passage and approval.
