ORDINANCE N0.
AN ORDINANCE TO REZONE LOTS 14, 15, 16, 17, 25, 26,
27, 28 AND 29; THE EAST 40 FEET OF LOT 18 AND THE SOUTH
25 FEET OF VACATED FOURTH STREET LYING NORTH OF LOTS 25,
26, 27, 28 AND 29, HULBERT HEIGHTS SUBDIVISION, WEST
MEMPHIS, ARKANSAS
WHEREAS, application was made to the City Planning Commission
to rezone the hereinafter described property and after notice having
been published for the time and in the manner as provided by
Ordinance No. 1258 the matter was heard by the City Planning
Commission and after hearing the presentation made on behalf of the
applicants and by the applicants personally and hearing those
persons voicing opposition to the rezoning the Planning Commission
recommended that said application be disapproved; and
WHEREAS, after the hearing notice in writing was given to the
applicants of the disapproval and the reasons therefor; and
WHEREAS, within due time the petitioners filed their appeal
to the City Council stating specifically in writing why they

considered the Planning Commission's findings and decisions were in
error; and

WHEREAS, after reviewing the recommendation of the Planning

Commission and the petition for appeal by the petitioners,
statements of counsel for peti_ti_oners and of the petitioners
personally the City Council is of the opinion that the
recommendation of the Planning Commission is in error and that the
aforesaid Ordinance should be amended by granting the request of the
petitioners.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WEST MEMPHIS ARKANSAS:
SECTION I: That the following described property, to wit:
Lots 14, 15, 16, 17, 25, 26, 27, 28 and 29; the east 40 feet
of Lot 18 and the south 25 feet of vacated Fourth Street
~ lying north of Lots 25, 26, 27, 28 and 29, Hulbert Heights
Subdivision, West Memphis, Arkansas, and being the
properties located at 300 and 364 Washington Street,
be and the same is hereby rezoned I-1 General Industrial
