ORDINANCE NO. 3.1_ S~
AN ORDINANCE INCREASING THE MAYOR'S AUTHORIZATION TO APPROVE
PAYMENT OF BILLS, DEBTS AND LIABILITIES; AMENDING SECTION 5
OF ORDINANCE 1225; DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES.
WHEREAS, the monthly payment for the wastewater treatment

plant operator exceeds the Mayor's present authority and
requires monthly approval by the West Memphis City Council;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
SECTION 1. Section 5 of Ordinance 1225 is hereby amended to
read as follows:
That the Mayor, or the Mayor's duly authorized
representative, may approve for payment out of any funds
previously appropriated for that purpose, or disapprove any
bills, debts or liabilities, where the total expenditure
therefore is below the sum of Fifty Thousand ($50,000.00)
Dollars. Provided, however, the Mayor's approval of
expenditures for bonded indebtedness, purchase of electric
power and sales tax shall not be restricted to the above
limitation. The payment or disapproval of any bills, debts
or liabilities not covered by a previous appropriation and
those that exceed the above limitation shall require
confirmation of the City Council.
SECTION 2. Ordinance 1338 and all other ordinances or parts
of ordinances in conflict herewith are hereby repealed.
SECTION 3. EMERGENCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there is an urgent need by the City of West
Memphis to increase the Mayor's authority to approve for payment
bills, debts or liabilities up to the amount stated herein, an
emergency is hereby declared to exist, and this ordinance, being
necessary for the preservation of the public peace, health,
safety and welfare of the Citizens of West Memphis, Arkansas,
shall be in full force and effect from and after the date of its
passage and approval.
