AN ORDINANCB TO MAIVB CO!lPSTITIVB BIDDING, DBCLARING AN
BMBRGBNCY AND FOR OTHBR PURPOSBS.
MHBRBAB, Arkansas Code Annotated Section 14-58-303 allows
waiving of competitive bidding in exceptional situations where
such procedure is deemed not feasible or practical; and
MHERBAS, there are many items necessary for the City's use
where competitive bidding is deemed not feasible or practical;
NOM, THBRBFORB, BB IT ORDAINBD BY THB CITY COUNCIL OF THB
CITY OF MS3T I~BMPHIB, ARKANSAS:
1. That competitive bidding be waived for the following:
One automatic source transfer switch gear - pad mounted.
Competitive bidding is being waived for the reason that this
switch gear is needed to replace a switch gear in the vicinity
of Crittenden Memorial Hospital to prevent a possible loss of
power to the hospital facilities and time is of the essence and
competitive bidding under such circumstances would not be
feasible or practical.
2. Emerstency Clause. It having been found and determined by
the City Council of the City of West Memphis, Arkansas, that
there is an urgent need to replace an automatic source transfer
#~en~e~ switch gear servicing hospital facilities, an emergency
is hereby declared to exist, and this Ordinance being necessary
for the preservation of the public peace, health, safety and
welfare of the Citizens of West Memphis, Arkansas, shall be in
full force and effect from and after the date of its passage and
approval.
