AN ORDINANC= TO MAI1/! COMPETITIVB BIDDING, DECLARING AN
EM~t38NCY AND FOR OTHER PURPOSES.
iiHBREAS, Arkansas Code Annotated Section 14-58-303 allows
waiving of competitive bidding in exceptional situations where
such procedure is deemed not feasible or practical; and
MHBRBAB, there are many items necessary for the City's use
where competitive bidding is deemed not feasible or practical;
NOM, THEREFORE, BB IT ORDAINED BY THE CITY COUNCIL OF T9E
CITY OF NEST APHIS, AR[ANSAB:
1. That competitive bidding be waived for the following:
Two (2) Flygt mixers to be installed in the retrofitted
ditch at the West Memphis Sewer Treatment Plant, upon approval
of Bond Consulting Engineers.
Competitive bidding is being waived for the reason that
these items are necessary to improve velocity in the retrofitted
ditch in order to avoid non-compliance with Federal and/or State
standards and time is of the essence and competitive bidding
under such circumstances would not be feasible or practical.
2. Emergency Clause. It having been found and determined by
the City Council of the City of West Memphis, Arkansas, that
there is an urgent need to improve the velocity in the
retrofitted ditch to aid in complying with Federal and/or State
standards, an emergency is hereby declared to exist, and this
Ordinance being necessary for the preservation of the public
peace, health, safety and welfare of the Citizens of West
Memphis, Arkansas, shall be in full force and effect from and
after the date of its passage and approval.
