AN ORDINANCE TO iiIAIVE COl~IPBTITIVE BIDDINt3, DECLARINt3 AN
ElIER(1SNCY AND FOB OTHER PURPOSES .
WHERBAS, Arkansas Code Annot^a~ted Section 14-58-303 allows
waiving of competitive bidding in exceptional situations where
such procedure is deemed not feasible or practical; and
i~THEREAS, there are many items necessary for the City's use
where competitive bidding is deemed not feasible or practical;
NOM, THEREFORE, BB IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST PIBI4PHIS, ARKANSAS:
SECTION 1. That competitive bidding be waived for the
following:
The annual audit of the West Memphis Utility Commission by
the accounting firm of Dodge, Thomas, Goss 8c Owens, Ltd.
Competitive bidding is being waived for the reason that
this involves professional accounting services and competitive
bidding on a yearly basis under these circumstances would not
be feasible, practical or economical to the City.
3ECTION 2. EKBRaENCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there is an urgent need to retain the services
of an accounting firm for the annual audit of the West Memphis
Utility Commission, an emerge~cy is hereby declared to exist,
and this Ordinance being necessary for the preservation of the
public peace, health, safety and welfare of the Citizens of
West Memphis, Arkansas, shall be in full force and effect from
and after the date of its passage and approval.
