AN ORDINANCE TO REPEAL 3SCTIONS 3, 4 AND 5 OF ORDINANCE
202, TO ELIMINATE THS REQUIREMENT OF FILING
INFORMATIONS FOR PROSECUTIONS BY TH8 CITY ATTORNEY IN
MUNICIPAL COURT, DECLARING AN EMERGENCY, AND FOR OTHER
PURPOSES.
WHEREAS, Sections 3, 4 and 5 of Ordinance 202 adopted
in 1951 and codified as Sections 2.51.030 and 2.51.040 and
2.51.050 of the West Memphis Municipal Code, require the
City Attorney to proceed by Information against persons
charged with violation of City ordinances or State statutes
and set out the requirements and form of such Information
for Warrant of Arrest; and
WHEREAS, the necessary procedures to be followed by the
City Attorney are set out in the Arkansas Code Annotated
and in the Rules of Criminal Procedure; and
WHEREAS, the present effect of Sections 3, 4 and 5 of
Ordinance 202 has been to unnecessarily increase the amount
of paperwork of the City Attorney's office and the West
Memphis Municipal Court,
NOW, THEREFORE, BB IT ORDAINED BY THE CITY COUNCIL OF
THS CITY OF WEST MBMPHIS, ARSANSAS:
SECTION 1. Sections 3, 4 and 5 of Ordinance 202 adopted
in 1951 and codified as Sections 2.51.030 and 2.51.040 and
2.51.050 of the West Memphis Municipal Code are hereby
repealed.
SECTION 2. EMERGENCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there is an urgent need to eliminate
unnecessary procedural requirements for prosecutions by the
City Attorney in the West Memphis Municipal Court, an
emergency is hereby declared to exist, and this Ordinance
being necessary for the preservation of the public peace,
health, safety and welfare of the Citizens of West Memphis,
Arkansas, shall be in full force and effect from and after
the date of its passage and approval.
