ORDINANCE NO. I~tIH
AN ORDINANCE TO AMEND ORDINANCE 1258 TO REDUCE TH8
MINIMUM SIZE OF A PLANNED UNIT DEVELOPMENT FROM THREE
ACRES TO TWO ACRES AND FOR OTHER PURPOSES.
WHEREAS, after a public hearing upon due notice and
publication, the Planning Commission approved and
recommended for adoption certain proposed amendments to the
zoning regulations adopted by Ordinance 1258, the Zoning
Ordinance; and
WHEREAS, the proposed amendments will reduce the
minimum required size for a Planned Unit Development from
three (3) acres to two (2) acres; and
WHEREAS, it is necessary and in the best interests of
the City of West Memphis that these proposed amendments be
adopted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Article III, Section 4(B)(2) of the text
adopted by Ordinance 1258 is hereby amended to read as
follows:
The minimum area for a "PUD" Planned Unit Development
District shall be two (2) acres. In calculating the
minimum area for a PUD District, the measurements shall
include the area of all dedicated streets entirely
within the boundary of the proposed PUD and one-half of
the area of all boundary or perimeter streets.
SECTION 2. Article III, Section 4(E)(1)(a) of the text
adopted by Ordinance 1258 is hereby amended to read as
follows:
That the tract of land for the entire project comprises
not less than two (2) acres.
SBCTION 3. All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
