AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE
PURCHASE OF HEALTH INSURANCE FOR EMPLOYEES OF THE
CITY OF WEST MEMPHIS,AND THEIR DEPENDENTS,IF SELECTED,
AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 authorizes the waiving of
competitive bidding in exceptional situations where competitive bidding is deemed not feasible
or practical; and
WHEREAS, the City of West Memphis is in need of acquiring a health insurance for
employees of the City of West Memphis, and dependents, if selected, to begin on January 1,
2014; and
WHEREAS, the Insurance Committee has received and reviewed proposals for health
insurance for employees of the City of West Memphis, and their dependents, if selected, and has
recommended to the City Council that the proposal of CIGNA Insurance Company be accepted;
and
WHEREAS, the City Council determines that competitive bidding should be waived for
the reason that the time required for implementation of the Affordable Care Act makes
competitive bidding under such circumstances not be feasible or practical and that the
recommendation of the Insurance Committee should be approved;
NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS,ARKANSAS THAT:
SECTION 1. Competitive bidding is hereby waived for the purchase health insurance
for employees of the City of West Memphis, and their dependents, if selected, TO BEGIN ON
January 1, 2014,pursuant to the proposal submitted to the Insurance Committee by CIGNA
Insurance Company, a copy of which is before the City Council at this meeting.
SECTION 2. All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
