WHEREAS, application has been made to the City Planning
,~ Commission to allow a Soer..ia1 Per~:Zitted Use of a specialized

rr` health care facility in a R-2 Low Density Residential District,
as required by Ordinance 1258, as amended.
WHEREAS, after Notice had been published for the time
and in the manner as provided by Ordinance ^10. 1258, as amended,
the matter was heard by the City Planning Conrn;.>sion and the
Planning Commission recommended that a Special Permit Use be
- granted to said property to permit the specialized health care
facility in the R-2 Low Density Residential District subject
to the special conditions as follows:
1. Two sing?.e one-story structures with a total
of 7,600 square feet.
2. Not to exceed five (5) patients per building.
3. ilot to exceed t~~~o curb cuts for Lot 2 -
with approval by City Engineer.
4. Off street parking - 6 spaces required with no direct

NOW, THEREFORE, BE IT ORDAINF,D BY THE CITY COUNCIL OT'

SECTION I: That the following described property, to
wit:
Lot 2, Badell Subdivision, to the City of
West Memphis, Crittenden County, Arkansas,
(being located at 208 West Jackson Avenue)
be, and the same hereby is granted a Special Permit Use per-
mitting the usage caf a specialized health care facility- with
the special conditions as follows:
1. Two single one-story structures with a Dotal of
7,600 square feet.
2. Not to exceed five (5) patients per building.
3. Not to exceed two curb cuts for Lot 2 -

SECTION II: That all Ordinances or parts of Ordinances
in conflict herewith are hereby repealed.
SECTIOPI III: That it has been found and determined by
the City Council of the City of Jest I~Semphis, that this pro-
perty is in the process of being the facility of the specialized
health care facility and made available for public use and
the immediate passage of this Ordinance is necessary for the
development and use of said property for the purposes of a
specialized health care facility. That the Council is of the
opinion that the passage of the same is necessary for the
growth and expansion of the City of ~vTest P-Zernphis, Arkansas,
and in the interest of the public health, peace, safety and
welfare of the City of ~~est Me-nphis and the inhabitants there-
of. Therefore, an emergency is hereby declared to exist and
this Ordinance shall take effect and be in full force and
effect inulediately upon its passage and approval.
