AN ORDINANCE TO AMEND 38CTION 12.48.080 OF THE WEST
MEMPHIS MUNICIPAL CODE TO AUTHORIZE THE USE OF PROPERLY
LICENSED SUBCONTRACTORS, DECLARING AN EMERGENCY, AND
FOR OTHER PURPOSES.
WHEREAS, Ordinance 982, Section 6, as amended by
Ordinance 1309, Section 3, prohibits any person, firm or
corporation possessing a mechanical contractor's license
from permitting any person other than his employees to work
under his license and/or permit; and
WHEREAS, the Board of Mechanical Heating and Air
Conditioning Installers Examiners has recommended that this
provision be amended to allow a subcontractor, properly
licensed by the State of Arkansas, to perform work under
the license and/or permits of a licensed mechanical
contractor;
NOW, THEREFORE, BS IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
1 SECTION 1. Ordinance 982, Section 6, as amended by
Ordinance 1309, Section 3, and codified as Section
12.48.080 of the West Memphis Municipal Code is hereby
amended to read as follows:
Any person, firm or corporation desiring to engage in
the business of installing, remodeling or altering of
mechanical heating and air conditioning equipment
within the city shall possess a valid mechanical
contractor's license issued by the State of Arkansas.
No person, firm or corporation possessing a mechanical
contractor's license shall permit any person other than
his employees, or a subcontractor possessing a valid
sechanical contractor's Zicense issued by the State of
Arkansas, to work under his license and/or permits.

SECTION 2. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
SECTION 3. EI~ER(3ENCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there is an urgent need by the City of West
Memphis and the Board of Mechanical Heating and Air
Conditioning Installers Examiners to amend the licensing
regulations to permit properly licensed subcontractors to
performing work of installing, remodeling or altering of
mechanical heating and air conditioning equipment, an
emergency is hereby declared to exist, and this Ordinance
being necessary for the preservation of the public peace,
health, safety and welfare of the citizens of West Memphis,
Arkansas, shall be in full force and effect from and after
the date of its passage and approval.
