AN ORDINANCE TO AMEND ORDINANCE 1258, THE ZONING
ORDINANCE, TO INCLUDE HAULING, MOVING OR STORAGE
COMPANY AS A SPECIAL PERMIT USE IN A C-1 DISTRICT,
DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, after a public hearing upon due notice and

publication, the Planning Commission approved and
recommended for adoption certain a proposed amendment to
the zoning regulations adopted by Ordinance 1258, as
amended, the Zoning Ordinance; and
WHEREAS, the proposed amendment will include "Hauling,
Moving or Storage Company" as a Special Permit Use in a C-1
District; and
WHEREAS, it is necessary and in the best interests of
the City of West Memphis that these proposed amendments be
adopted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. The designation of "Hauling, Moving or

hereby amended to read as follows:

SECTION 2. All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.

SECTION 3. EMERGENCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there exists an urgent need to amend the
text of the Zoning Ordinance as adopted by Ordinance 1258,
as amended, to provide for the orderly growth and
development of the City of West Memphis as proposed by the
Planning Commission, an emergency is hereby declared to
exist, and this ordinance being necessary for the
preservation of the public peace, health, safety and
welfare of the citizens of West Memphis, Arkansas, it shall
be in full force and effect from and after the date of its
passage and approval.
