AN ORDINANCE GRANTING A SPECIAL PERMIT USE OF LOT
2 BEDELL SUBDIVISION TO THE CITY OF WEST MEMPHIS,
ARKANSAS (208 WEST JACKSON AVENUE); AHD DECLARING
AN EMERGENCY.
WHEREAS, application has been made to the City Planning
Commission to allow a Special Permitted Use of a specialized
health care facility in a R-2 Low Density Residential District, as
required by Ordinance 1258, as amended.
WHEREAS, after Notice had been published for the time
and in the manner as provided by Ordinance No. 1258, as amended,
the matter was heard by the City Planning Commission and the
Planning Commission recommended that a Special Permit Use be
granted to said property to permit the specialized health care
facility in the R-2 Low Density Residential District subject to
the special conditions as follows:
1. Two single one-story structures with a total
of 7, 600 square feet.
2. Hot to exceed ten (10) patients per building,
a total of twenty (20).
3. Hot to exceed two curb cuts for Lot 2 - with
approval by the City Engineer.
4. Off street parking - 12 spaces required with
no direct ingress or egress onto West Jackson
Avenue.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
SECTION I: That the following described property, to
wit:
Lot 2, Bedell Subdivision, to the City of West
Memphis, Crittenden County, Arkansas, (being
located at 208 West Jackson Avenue)
be, and the same hereby is granted a Special Permit Use permitting
the usage of a specialized health care facility with the special
conditions as follows:
1. Two single one-story structures with a total
of 7, 600 square feet.

2. Hot to exceed ten (10) patients per building,
a total of twenty (20).
3. Not to exceed two curb cuts for Lot 2 - with
approval by the City Engineer.
4. Off street parking - 12 spaces required with
no direct ingress or egress on to West Jackson
Avenue.
SECTION II: That all Ordinances or parts of Ordinances
in conflict herewith are hereby repealed.
SECTION III: That it has been found and determined by
the City Council of the City of West Memphis, that this property
is in the process of being the facility of the specialized health
care facility and made available for public use and the immediate
passage of this Ordinance is necessary for the development and use
of said property for the purposes of a specialized health care
facility. That the Council is of the opinion that the passage of
the same is necessary for growth and expansion of the City of West
Memphis, Arkansas, and in the interest of the public health,
peace, safety and welfare of the City of West Memphis and the
inhabitants thereof. Therefore, an emergency is hereby declared
to exist and this Ordinance shall take effect and be in full force
and effect immediately upon its passage and approval.
