1451ORDINANCE N0. I~ ~' AN ORDINANCE TO REZONE LOTS 3 AND 4 OF REGENCY SUBDIVISION AND GRANTING A SPECIAL PERMITTED USE THEREOF AND TO REZONE LOT5 5, 6, 7, 8, 9, 10 AND 11, BLOCK 6, A PORTION OF ALLEY RUNNING THROUGH BLOCK 6 AND PORTIONS OF 20TH STREET AND WHEELER AVENUE, WHEELER SUBDIVISION, WEST MEMPHIS, ARKANSAS, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES WHEREAS, applications were made to the City Planning Commission to rezone the hereinafter described property and to allow a special permitted use as to Lot 3 and 4 of Regency Subdivision for storage facilities in an office building and after notices having been published for the time and in the manner as provided by Ordinance No. 1258 the matters were heard by the City Planning Commission and no persons appearing to protest the same the Planning Commission recommended that said applications be granted. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS ARKANSAS: SECTION I: That the following described property, to wit: Lots 3 and 4 of the Regency Subdivision in the city of ' West Memphis, Arkansas, as shown by plat of record in Plat Book 3 at page 332. Lots 5, 6, 7, 8, 9, 10 and 11 and that part of the vacated alley bounded on the north by Lots 5 and 6 and on the south by Lot 7, all in Block 6 of the Wheeler Subdivision in the City of West Memphis, Arkansas, as shown by plat of record in Plat Book 2 at pages 113 and 114. That part of vacated 20th Street abutted on the west by Lot 11 in Block 6 of the Wheeler Subdivision as shown by the above plat and on the east by Lot 5 of the Regency Subdivision as shown by plat of record in Plat Book 3 at page 332, more particularly described as beginning at the southeasterly corner of said Lot 11, thence north to the northeasterly corner of said Lot 11, thence east 60 feet to the west line of Lot 5 of the Regency Subdivision, thence south along the west line of said Lot 5 to a point east of the point of beginning, thence in a westerly direction to the point of beginning. That part of vacated Wheeler Avenue bounded on the north by Lots 8, 9, 10 and 11 in Block 6 of the Wheeler Subdivision and the width of 20th Street as shown by plat thereof and on the south by Lot 4 and a part of Lot 3 of the Regency Subdivision as shown by the plat of said subdivision, being more particularly described as beginning at the southwesterly corner of said Lot 8, thence in an easterly direction along the northerly line of Wheeler Avenue to a point in the westerly line of Lot 5 of the Regency Subdivision, thence in a southerly direction to the north line of said Lot 3 of Regency Subdivision, thence westerly to the northwesterly corner f of Lot 3 of the Regency Subdivision, direction along the westerly line northeasterly corner of Lot 4 of the thence westerly along the northerly the northwesterly corner of said northerly to the point of beginning. thence in a southerly of said Lot 3 to the Regency Subdivision, line of said Lot 4 to Lot 4, and thence be and the same is hereby rezoned C-2 Open Display Commercial District. SECTION II: That the following described property, to wit: Lots 3 and 4 of the Regency Subdivision be and the same is hereby granted a Special Permit Use allowing and permitting the use of the building to be constructed thereon to be additionally used for inside storage by the occupants for storing any goods, equipment or materials belonging to them. SECTION III: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION IV: EMERGENCY CLAUSE: It is found and declared by the City Council that this property is in the process of further development and that this ordinance is necessary for the orderly growth and expansion of the City of West Memphis and for the protection of the safety and welfare of the inhabitants of the City of West Memphis; therefore, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage and approval.
